Software licence

This licence covers the software we distribute: the @apex-actions/cli package, the container images published under ghcr.io/apex-actions, the runner binary and the machine images that carry it, and any other software we publish that refers to this page. It does not cover the hosted service, which the terms of service govern; the two are different things and are licensed separately.

The software is licensed, not sold. It is provided by Pristine Technology, doing business as Apex Actions, a Texas company ("we"). It is proprietary, and every right not granted here is reserved.

What you may do

We grant you a non-exclusive, non-transferable, revocable licence to install and run the software:

• the command-line tool, on any machine, for use with the hosted service or with a deployment of the service you are entitled to use;
• the container images and the runner, to operate a deployment of the service that a written agreement with us entitles you to operate, on the infrastructure that agreement names.

You may make copies as needed to do that, including in your own CI and on your own machine images.

What you may not do

You may not distribute, sublicense, sell, rent or lend the software, or make it available to anybody who is not entitled to use it under this licence. You may not modify it, make derivative works of it, or remove or alter any notice in it. You may not reverse engineer, decompile or disassemble it except to the extent that the law expressly allows despite this clause. You may not use it to build a competing service, and you may not use it in breach of the acceptable use policy.

Third-party software

The software contains components licensed by others under their own terms — open-source licences among them. Those terms are in the notices distributed with the software, and this licence does not restrict any right they give you. Where a third-party licence conflicts with this one, it prevails for that component.

Updates

We may publish updates. An update is licensed under the version of this licence in force when it is published, which will refer to this page. We do not have to support a version we no longer publish.

Term

This licence lasts until it ends. It ends if you breach it, when the agreement that entitles you to run a deployment ends, or when you stop using the software. When it ends you stop using the software and delete your copies. Sections "Third-party software" onward survive.

Warranty and liability

The software is provided as it is, without warranty of any kind, and the disclaimers and limitations in the terms of service apply to it as they apply to the service. Where you run the software on your own infrastructure, what it does there is under your control and is your responsibility.

General

This licence is governed by the same law, and subject to the same courts, as the terms of service. It is the whole agreement about the software unless a written agreement signed by both of us says otherwise; where such an agreement exists it prevails.
